TERMS & CONDITIONS OF UTV RENTAL
As the primary renter, you are entering into a binding agreement with Epic 4X4 Adventures, Inc. (“Company”). These Terms & Conditions apply in addition to any agreements made through Polaris Adventures and are enforceable by law.
Your safety—and the safety of those around you—is our top priority.
These Terms & Conditions are designed not only to protect our vehicles, but to help ensure a safe, fun, and unforgettable experience in Moab’s rugged terrain. Our goal is to help you avoid additional fees for damage or policy violations. By laying out clear, straightforward guidelines, we make it easy for you to keep your protections intact and enjoy your adventure worry-free.
Unlike many off-road destinations, Moab presents extreme trail conditions, steep ledges, technical obstacles, and unpredictable terrain. We ask that all renters operate within their skill level and comply fully with all restrictions, safety practices, and trail regulations to help preserve this incredible environment and protect themselves.
1. SAFETY & EQUIPMENT USE
Your rental includes access to designated trails in Grand County and San Juan County, Utah only. Epic 4X4 Adventures vehicles are not to be operated recklessly, carelessly, or beyond your personal skill level. You are expected to follow all posted trail regulations including trail speed limits, local laws, and our company safety standards.
We maintain our fleet to the highest standard, and we expect the same of your conduct. Damage from abuse, negligence, or unauthorized trail use will result in full financial responsibility.
2. RESTRICTED AREAS & OBSTACLES
The following roads, trails, and obstacles are strictly prohibited. Entering any of these areas voids all damage protection and caps. GPS tracking is active and used to verify trail access. Violations will result in immediate termination of your rental without refund, assessment of additional fees, and forfeiture of your deposit.

If you decide to make any of the above part of your experience, additional charges will be incurred starting at $500 per area accessed, up to your full deposit, regardless of the condition of the vehicle upon return. This is in addition to any damage that may result. Recovery of our vehicle in any of these areas or from these obstacles starts at $2000. Epic 4X4 Adventures DOES NOT MAKE EXCEPTIONS to this policy.
Moab offers hundreds of miles of exceptional off-road trails, scenic routes, and thrilling terrain. Avoiding additional fees is easy with responsible recreation. Our vehicles are not the platform to test your skills or push limits. We maintain the finest rental fleet in Moab, combined with the most comprehensive program—and we are proud to serve respectful guests who share our commitment to safety, stewardship, and the spirit of adventure.
3. GPS TRACKING & MONITORING
All rental vehicles are GPS-tracked. We reserve the right to monitor your location, driving behavior, and speed.
Tampering with, disabling, or attempting to interfere with the tracking system will result in immediate termination of your rental without refund, forfeiture of your deposit, and possible legal action.
4. CLEANING POLICY & PROHIBITION ON WASHING
Our UTVs are highly sensitive to moisture in critical systems, and improper washing can cause severe mechanical or electrical failure. For this reason, cleaning is already included in your rental fees, and guests are strictly prohibited from washing or rinsing the vehicle. Any guest who attempts to wash a vehicle will be subject to penalties up to $500 and held fully responsible for any resulting damage.
While guests are not required to clean or wash the vehicle before returning it, excessive mud inside the vehicle, on the roof, or heavy exterior buildup will result in a mandatory cleaning fee of up to $250, without exception.
Protecting your adventure—and avoiding additional charges—is easy with responsible recreation. Pass slowly and cautiously through water or mud only when necessary. Do not play in water, sand, or mud areas. Reckless use may result in additional penalties and cancellation of your rental privileges.
5. DISPUTES & CHARGEBACKS
We are committed to handling all charges with fairness and transparency. If your vehicle is returned damaged or in violation of our Terms & Conditions, you are entitled to a detailed explanation, written estimate, and itemized invoice upon request. We welcome open dialogue and encourage you to reach out directly if you feel a charge has been applied in error.
However, by agreeing to these Terms & Conditions, you authorize all charges related to your rental—including but not limited to:
- Damage or loss
- Trail violation penalties
- Recovery costs
- Loss-of-use fees
If you bypass direct communication and initiate a chargeback for a valid charge, Epic 4X4 Adventures, Inc. will immediately pursue legal action, including a lawsuit filed in the State of Utah. All attorney’s fees, collection costs, and court fees will be added to the amount owed.
We understand credit card companies are structured to favor the cardholder and prefer to handle disputes through direct dialogue—or, if necessary, through the courts where both sides are heard equally.
We do not tolerate fraudulent credit card disputes.
6. CODE OF CONDUCT
By taking possession of the vehicle(s), you agree to operate it in a safe, respectful, and responsible manner, consistent with Company policies, Tread Lightly principles, and local laws. The following rules apply to all renters and drivers:
- No racing or contests of speed or performance.
- Ride Command routes, trail suggestions, and tips provided by Epic 4X4 Adventures are offered solely for convenience and do not constitute endorsement of trail conditions or your ability to navigate them safely. Trail conditions can change daily, and we may not be aware of current hazards. You remain fully responsible for your decisions, actions, and any resulting damage—regardless of whether you followed a suggested path.
- Do not play in water, sand, or mud areas. Pass slowly and cautiously through water or mud only when necessary. Abuse of the vehicle in this way is grounds for additional penalties and cancellation of your rental privileges.
- Ride at your current skill level. Do not push beyond your ability.
- Stay on designated OHV trails. Do not explore outside approved areas.
- Follow all posted signs, speed limits, and trail regulations. Drive at an appropriate speed for trail conditions. Trail speeds are limited to 15–25 MPH, but in some terrain, this may still be considered excessive.
- The UTV is street legal only for the purpose of accessing trailheads. Do not drive around town for sightseeing or errands.
- Overnight rentals must be parked by 10:00 PM.
- Do not tow any person or object with this vehicle. Do not allow this vehicle to be towed, pulled, or winched.
- Do not alter, modify, or tamper with any part of the vehicle.
- ALWAYS take care of our equipment. Our UTVs can cost over $45,000 each. If you damage or total a vehicle while violating company policies, we expect you to pay for it immediately.
7. DAMAGE DEPOSIT HOLD
A $3000 damage deposit authorization is required per vehicle on a valid credit card. This deposit protects against financial loss from any damage and policy violations during your rental. The individual providing the deposit is financially responsible for any damage or infraction—regardless of who was behind the wheel when the incident occurred.
If members of a group wish to take personal responsibility for their own driving time, individual deposit authorizations may be taken upon request. Each will be for the full $3000; the amount is not divided or shared.
Your deposit will be held for up to 24 hours following your rental to allow for a full post-ride inspection and review of GPS data. If no issues are found, the authorization will be released within that window.
8. AGREEMENT ACKNOWLEDGMENT
By signing this agreement, you:
- Acknowledge these Terms & Conditions are in addition to any Polaris Adventures rental documentation.
- Accept full financial and legal responsibility for the vehicle, passengers, and all actions taken during the rental period.
- Understand that any breach of these terms may result in fines, termination of rental, and legal action.
- Waive your right to dispute authorized charges resulting from violation of these terms.
